Terms and Conditions for thepplsplug.com
Last Updated: January 1, 2025
These Terms and Conditions (“Agreement”) govern your use of thepplsplug.com (the “Site”), a marketplace that facilitates transactions between vendors and wholesale buyers. By using the Site, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, you should discontinue use of the Site.
Age Restrictions
Thepplsplug.com is strictly available to users aged 21 years or older. By accessing the Site, you confirm that you meet this requirement. We reserve the right to deny access to users who do not comply with this restriction.
To comply with California law, we require all users to complete an age verification process before accessing the platform or completing transactions. This verification may be conducted manually or through external ID verification services. Users must provide a valid government-issued ID to confirm their age. Failure to complete the verification process will result in restricted access to the Site and the inability to place orders.
Wholesale Marketplace Overview
Thepplsplug.com operates as a business-to-business (B2B) platform, allowing vendors to list products and wholesale buyers, such as retailers, dispensaries, and e-commerce businesses, to purchase them. Individual consumer transactions are strictly prohibited. Thepplsplug.com does not act as a vendor or retailer; instead, it provides a platform for third-party vendors to conduct business.
Vendor Responsibilities and Fees
Commission Structure
Vendors agree to pay a 5% commission on all completed sales through the Site. This commission is automatically deducted from vendor payouts. Even if a refund is issued to the buyer, commissions are non-refundable. We reserve the right to modify commission rates at any time, with notice sent to vendors via email.
Payment and Payouts
Vendor payouts are processed weekly through the selected payment method on the vendor’s account. The frequency of payouts may be adjusted at our discretion. All commissions are deducted before payouts are issued. Vendors are responsible for ensuring their payment details are accurate.
Vendor Dashboard
Vendors have access to a dashboard to manage product listings, track orders, analyze sales data, and update business information. The dashboard also includes a COA management system where vendors must upload and track Certificates of Analysis (COAs) for all products listed.
Certificates of Analysis (COAs)
COA Requirements
All products listed on thepplsplug.com must have a valid Certificate of Analysis (COA) issued by a certified laboratory. COAs must be clearly readable, authentic, and not expired. A COA is considered valid for one year from its laboratory release date.
Vendor Liability
Vendors are solely responsible for ensuring that all COAs are accurate, up to date, and compliant with applicable regulations. Thepplsplug.com reviews COAs for compliance but is not responsible for their accuracy or authenticity. Any legal issues, regulatory actions, or buyer disputes related to COAs are the vendor’s responsibility.
Non-Compliance
Failure to provide a valid COA may result in product removal, account suspension, or termination.
Taxes and Compliance
Vendor Tax Responsibilities
Vendors are responsible for calculating, collecting, reporting, and remitting all applicable taxes on their sales. This includes sales tax, excise tax, and any other local or federal taxes. Thepplsplug.com provides optional tax calculation tools, but vendors must verify their accuracy and remain compliant with tax regulations.
Buyer Tax Exemptions
Wholesale buyers purchasing for resale must provide a valid resale or tax exemption certificate. Vendors are responsible for reviewing and maintaining these certificates in compliance with tax laws.
International Taxes and Duties
For international orders, buyers are responsible for understanding and paying applicable import duties, VAT, customs fees, or other taxes. Vendors must ensure their compliance with export regulations. Thepplsplug.com is not responsible for customs-related delays, losses, or fees.
Payment Terms
All transactions on the Site are processed in U.S. dollars. Thepplsplug.com acts as a marketplace facilitator but does not process direct payments between vendors and buyers. Any disputes regarding payments must be resolved directly between the parties.
Shipping and Fulfillment
Vendors are responsible for managing shipping, carrier selection, and tracking information. Products can only be shipped to states where cannabis and hemp-derived products are federally and locally legal. Vendors must handle shipping disputes directly with buyers. Thepplsplug.com recommends that buyers purchase shipping insurance, as we are not liable for lost or damaged shipments.
Refund and Return Policy
All refunds and returns are subject to the Refund and Return Policy outlined by each vendor. Vendors must process refund requests in a timely manner. Thepplsplug.com does not issue refunds and is not liable for refund disputes between vendors and buyers.
Commission fees paid to thepplsplug.com are non-refundable, even if a refund is issued by the vendor.
Prohibited Activities
The sale of illegal or non-compliant hemp-derived products is strictly prohibited. Vendors and buyers are responsible for ensuring their transactions comply with local, state, and federal laws. Any vendor found selling prohibited products may have their account suspended or terminated without notice.
Dispute Resolution
Thepplsplug.com is not responsible for resolving disputes between vendors and buyers. All disputes must be handled directly between the involved parties. In cases where no resolution is reached, we may assist in mediation, but we do not assume legal responsibility for the outcome.
Privacy and Data Usage
By using thepplsplug.com, you agree to the collection and use of your personal data as outlined in our Privacy Policy. Vendors and buyers should review the Privacy Policy for details on how their information is handled.
Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time. Changes to commission rates, fees, or tax policies will be communicated to vendors via email. Continued use of the Site after any updates constitutes acceptance of the revised terms.
